Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WagDesk service, operated by Forva Systems LLC ("Company," "we," "us"). By signing up or using WagDesk, you agree to these Terms.

1. Eligibility & account

You must be at least 18 years old and able to enter binding contracts. You are responsible for the accuracy of the information you provide and for safeguarding your account credentials.

2. Free trial

New accounts receive a 30-day free trial. Unless you cancel before the trial ends, your subscription will begin automatically at the plan price you selected.

3. Subscriptions & billing

Subscriptions are billed monthly in advance at the rate of your chosen plan. You may cancel anytime from your dashboard; cancellation stops future billing but does not refund the current billing period unless otherwise required by law.

4. Acceptable use

You agree not to misuse the service, including by sending unlawful communications, violating telemarketing or consumer protection laws (including the TCPA), or attempting to disrupt or reverse-engineer the service.

5. Customer content & consent

You are responsible for obtaining all necessary consents from your customers for automated calls, texts, and emails sent via WagDesk in compliance with applicable laws.

6. Intellectual property

WagDesk and all related software, trademarks, and content are owned by Forva Systems LLC. We grant you a limited, non-exclusive, non-transferable right to use the service during your subscription.

7. Disclaimers

The service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted operation or that the service will meet every business need.

8. Limitation of liability

To the maximum extent permitted by law, Forva Systems LLC's total liability for any claim under these Terms is limited to the amount you paid us in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account for violation of these Terms or non-payment. You may terminate your account at any time from your dashboard.

10. Governing law

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in Missouri.

11. Changes

We may modify these Terms. Material changes will be communicated by email or in-app notice and become effective upon posting.
